In order to strengthen the connection and cooperation of design industry between Hong Kong and Shenzhen, the Hong Kong Federation of Design Associations (FHKDA), together with the Shenzhen Industrial Design Professional Association (SIDA) co-founded "Design Hub". 1. Acceptance of Terms
By accessing or using our Services, you agree to be bound by these Terms,
1.1 These Terms of Service (“Terms”) govern your access to and use of Designhub.net or services (“Services”) referencing these Terms. Before using any of the Services, you are required to read, understand and agree to these Terms carefully, and contact us if you have any questions.

2.1 You may use our Services only if you can form a binding contract with Designhub.net, and only in compliance with these Terms and all applicable laws.
2.2 You may need to create an account with us in order to use our Services. It is your responsibility to keep your log-in credentials secure and you are responsible to Designhub.net for all activities that occur via your account. When you create your Membership account, you must provide us with accurate and complete information.
2.3 For Service Eligibility, any use or access by anyone under the age of 13 is prohibited. It is legal for you to use our Services, and you are legally capable of entering into a binding contract.
2.4 If you open an account on behalf of a company, organization, or other entity, then (a) "you" includes you and that entity, and (b) you represent and warrant that you are authorized to grant all permissions and licenses provided in these Terms and bind the entity to these Terms, and that you agree to these Terms on the entity's behalf.
2.5 Don’t Abuse The Services: Please don’t use the Services to do anything unlawful, infringing, disruptive, harmful, threatening, abusive, tortious, defamatory, libelous, lewd, profane, obscene, hateful or otherwise objectionable. While you are free to promote your Creative Work on Designhub.net, do not spam other users via messaging or project comments. Don’t phish or collect other people’s information without their consent. Don’t frame our Services or our website without our approval. Don’t copy or imitate our design, layout, or look-and-feel of the Service. Only use our Service to post your own creative work. Don’t use the Services as a generic image hosting service such as for banner advertisements, etc. If our Web Management Team decides that your conduct violates the Terms of Service, which are incorporated here by reference, we may remove your content or disable your use of the Services at any time, with or without notice to you.
2.6 Impersonation. Designhub.net is all about creative professionals getting credit for what they create, we require that you (and you agree to) use your real name in your profile. If we in good faith believe that you have created an account impersonating another person, we may, in our sole discretion and after an internal investigation, either transfer your account to the person who you are pretending to be or terminate your account with no liability to you.
2.7 Pages describing the Services are accessible from around the world but this does not mean all Services or service features are available in your country, or that user-generated content available via the Services is legal in your country. Designhub.net may block access to certain Services (or certain service features or content) in certain countries. It is your responsibility to make sure your use of the Services is legal in the country where you live. Services are not available in all languages.
We care about the security of our users. While we work to protect the security of your content and account, Designhub.net cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account.
4. User Content
Designhub.net allows you to post content, including photos, videos, links, and other materials. Anything that you post or otherwise make available on our Website is referred to as "User Content”. You grant Designhub.net and its users a non-exclusive, royalty-free, transferable, store and display your User Content on Designhub.net solely for the purposes of operating, developing, providing, and using the Designhub.net Service. Nothing in these Terms shall restrict other legal rights Designhub.net may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reasons; including User Content that we believe violates these Terms or our policies.
4.2 Content Copyright
You retain all rights in, and are solely responsible for, the User Content you post to Designhub.net.
4.3 License to Your Content
Even though we don’t claim ownership of your content, we do need certain licenses to your content in order to operate and enable the Services. When you upload or submit content to our Services, you grant Designhub.net (and our parents and affiliates) a worldwide license to communicate, distribute, host, make modifications or derivative works (solely for the purpose of better showcase your work), publicly display, publicly perform, publish, reproduce, store, and use such content. The license granted by you is for the only purpose of operating, marketing, promoting, and improving our Services. We will attribute to you if we incorporate your content into feature or into promotional or marketing materials.
4.4 Accessing and Sharing Your Content
By submitting your content to our Services, you also give other Designhub.net users the right to share your content via various social medial platforms integrated with Designhub.net. We may offer you ways to access and remove your content. Our Service may also provide ways for you to limit the scope of use and access and other user’s access and use of your content. You are responsible for determining the limitations that are placed on your content and for applying the appropriate level of access to your content. We do not monitor or control what others do with your content. It’s your responsibility to let other users know how your content may be shared and adjust the setting related to accessing and sharing your content accordingly.
4.5 Creative Commons
Designhub.net has adopted and implemented the Creative Commons. For more information, please read details of licensed under CC BY-NC-SA 3.0 HK via http://hk.creativecommons.org .
5.1 We reserve the rights to review all content uploaded to the Services. We may use available technologies or processes to screen for certain types of illegal content (against the Principle of Hong Kong Basic Law) or other abusive content or behavior (for example, patterns of activity that indicate spam or phishing, or keywords that indicate adult content has been posted).
5.2 Designhub.net may access or disclose information about you, or your use of a service, (a) when it is required by law (such as when we receive a valid subpoena or search warrant); (b) to respond to your requests for customer service support; or (c) where we, in our discretion, think it is necessary to protect the rights, property or personal safety of Designhub.net, our users, or the public.
6. Third-Party Links, Sites, and Services
Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are owned/not owned or not controlled by Desiignhub.net. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Designhub.net, you do so at your own risk and you agree that Designhub.net will have no liability arising from your use of or access to any third-party website, service, or content.
We value hearing from our users, and are always interested in learning about ways we can make Designhub.net more awesome. If you choose to submit comments, ideas or feedback, you agree that we are free to use them without any restriction or compensation to you. By accepting your submission, Designhub.net does not waive any rights to use similar or related Feedback previously known to Designhub.net, or developed by its employees, or obtained from sources other than you.
8. Termination of License
8.1 You can terminate this license at any time by removing your content from the Services.
8.2 Following termination or deactivation of your account, or if you remove any User Content from Designhub.net, we may retain your User Content for a commercially reasonable period of time for backup, archival, or audit purposes.
8.3 Designhub.net and its users may retain and continue to use or display copies of your User Content that other users have stored or shared through Designhub.net for archival or backup purposes and for the research and investigation purpose.
8.4 We may add, modify, or remove features or functionalities, and we may terminate or suspend this license at any time with or without cause or notice to you. We may also stop providing Services to you, or add or create new limits to our Services at any time.
8.5 If the Service is terminated or discontinued, then we will make reasonable effort to notify you and provide an opportunity to retrieve your content. If your group administrator terminates your access to a Service, then you may no longer be able to access content that you or other members of the group have posted. You may, however, still access your content stored on your account.
9. Limitation of Liability
Management of Designhub.net or related parties from Hong Kong Federation of Design Associations (FHKDA) takes no responsibility and assumes no liability for any User Content that you or any other user or third party posts or transmits using our Services. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.
9.1 DESIGNHUB.NET SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
9.2 IN NO EVENT SHALL DESIGHHUB.NET, AND DESIGNHUB.NET’S LICENSORS OR SUPPLIERS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER.
9.3 THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN YOUR JURISDICTION.

11.2 Notice to You: We will give notices to you either via email, regular mail, text message, postings on or within the Services, or other means reasonable for the type of notice provided.
12. Report Abusing the Services
If you see others abusing the Services, please report any problematic behavior or content you see on our Services by sending to email@example.com or firstname.lastname@example.org .

If you believe the Services are hosting content/ or was disabled or removed by Designhub.net that infringes your copyright, please let us know by filling out the form that you will find here. If you would prefer to submit a written counter-notice to Hong Kong Federation of Design Associations (FHKDA) at 1/F InnoCentre, 72 Tat Chee Avenue, Kowloon Tong, Hong Kong that contains all of the following:
(a) Description of the copyrighted work(s) you believe is/are infringed or improperly removed, along with your user name;
(b) The exact location (URL) where the infringing material resides on the Service;
(c) Contact information so that we can reach you, such as email address, your physical address and telephone number;
(d) A statement by you that you have a good faith belief that the use of the Material identified in your notice in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(e) A statement by you that the information in your notice is accurate and, under penalty of perjury, which you are the copyright owner or are authorized to act on the copyright owner’s behalf.

Before you file an infringement notice, please carefully consider whether or not the use of copyrighted material at issue is protected by the “fair use” doctrine, as you could be liable for costs and attorneys’ fees should you file a takedown notice where there is no infringing use. 1. General Policy Statement
We pledge to meet fully, and where possible exceed, internationally recognized standards of personal data privacy protection, in complying with the requirement of the Hong Kong Personal Data (Privacy) Ordinance. In doing so, we will ensure compliance by our staff with the strictest standards of security and confidentiality.
2. Data collection and use
a. We collect personal data from our users (members) on a voluntary basis; data collected may personal and/ or company information include name, contact number, address, e-mail address, etc. The information is used by us for the purposes stated in the respective screens on which we invite you to provide your data. We may also use the information we collect for the following purposes of completing your registration.
b. When you visit our website, we record your visit only as a "hit" and do not collect any personal identifiable information about you. The "hit" information is to allow us to compile general statistics to show the daily number of visitors to our site.
c. When you visit certain services of our website, we collect general information about your visits by means of cookies files. The information is only used for analyzing your preference in relation to the service we provide; or to undergo research of the content popularity.
